§ 97.17. Permittee responsible for defects.

The person to whom the permit is issued shall be responsible for all defects in excavations occurring within two years from the completion of the work, and shall be liable for all damages resulting from any defects. The city shall maintain and repair all defective excavations during the two-year period of which it acquires notice, and all permittees shall promptly notify the city of any defects occurring in excavations. The cost of maintenance and repair during the two-year period shall be at the expense of the permittee.
