§ 51.06. Collection.

  • (a)

    The stormwater fee is to be invoiced annually to the owner of each lot or parcel which is subject to the stormwater fee. The period for which the fee is charged shall coincide with the city's fiscal period. The city manager or his designee shall cause invoices to be sent to the owner of record of each lot or parcel which is subject to the stormwater fee as soon as is practical for that fiscal period. The invoice shall be sent, by regular mail, to the most current address of the owner of record as reflected in the records in the city. Payment of the fee shall be due upon mailing of the invoices and shall become delinquent 45 days thereafter. All delinquent accounts will be subject to charges for interest, administrative fees, and/or penalties.

    (b)

    The stormwater utility fee provided herein shall constitute a lien against the property charged until the same has been paid in full. For the fiscal period of 1986-1987 the lien shall be effective as of the effective date of Ord. 86-131. For all fiscal periods thereafter, the lien shall be effective as of October 1 of each fiscal period. Collection of delinquent charges shall be the same as for collection of assessments as provided by F.S. ch. 173. The liens created hereby shall be co-equal with the lien of all state, county, district and municipal taxes, superior in dignity to all other liens, titles, and claims, until paid.

    (c)

    Delinquent fees shall bear interest at a rate of 12 percent per year until paid.

    (d)

    The city manager or his designee is directed to prepare a list of lots and parcels within the city and assign a classification of residential or nonresidential to each lot or parcel.

    (e)

    In addition to the methods of collection provided herein, any fees levied pursuant to the code may also be collected pursuant to the uniform method of assessing, billing and collecting of non-ad valorem assessments, as set forth in F.S. ch. 197, or any other method of collection as may, from time to time, be provided by law.
