§ 62.10. Water, wastewater and reclaimed water surcharge.

  • In addition to the rates, fees, and charges provided in the appendix to this chapter, all those new customers located in the unincorporated portions of St. Lucie County, Florida, who are not otherwise exempt pursuant to paragraph 5.7 of that Agreement of Transfer by and between St. Lucie County and the city shall pay a 25 percent surcharge to be applied to all such nonexempt classes of services of water, wastewater, and reclaimed water customers. In the event a court of competent jurisdiction enters a judgment determining that the covenants set forth in said paragraph 5.7 are invalid or otherwise prevents the city from surcharging new customers outside the city limits, and such judgment is upheld on appeal, then upon the date the appeal becomes final, all customers in the unincorporated portions of St. Lucie County shall pay said 25 percent surcharge.
