Article III. ENFORCEMENT |
§ 119.31. Enforcement; penalties.
(a)
In response to a violation of section 119.21 or 119.22, or subsection 119.23(a), the violator may be punished by a civil penalty not to exceed five hundred dollars ($500.00) per occurrence.
(b)
In response to a violation of subsection 119.23(a), a written warning and notice to comply with subsection 119.23(b) shall be issued to the proprietor or other person in charge of the enclosed indoor workplace in order to inform such person of the violation and encourage compliance with the law. For a subsequent observation of a violation of subsection 119.23(a), the proprietor or other person in charge may be punished by a civil penalty not to exceed five hundred dollars ($500.00) per occurrence.
(c)
Any condition caused or permitted to exist in violation of any of the provisions of this Code shall be deemed a public nuisance and shall be subject to abatement by the City.
(d)
Each and every act or action done in violation of the provisions of this Code shall be construed, deemed and taken as a separate and distinct violation of such provisions of this Code. Every day that a violation of the Code or any provisions hereof shall continue shall be deemed a separate and distinct violation of the provisions of this Code.
