§ 159.09. Appeals.

  • (A)

    Any decision made by the City Manager in the course of administering the provisions of this article may be appealed to the Council by filing a petition of appeal within thirty (30) calendar days of the date of the rendition of the decision.

    (B)

    The Council shall review the petition at a public meeting within thirty (30) calendar days from the date of filing the appeal. The petitioner shall be provided reasonable notice of the time, date, and place of the public meeting by certified mail, return receipt requested, and invited to attend. The Council's decision shall be final for the purpose of administrative appeals. The Council shall revoke the decision of the City Manager only if there is no competent and substantial evidence in the record supporting the decision of the City Manager or that there is no adequate legal basis for the decision of the City Manager or there was a failure to substantially comply with this article.
