§ 97.11. Application.

  • (a)

    The excavation permit shall be issued only upon a written application signed by the applicant and shall describe the place where the excavation is proposed to be made with such certainty that the excavation site may at all times be readily located. It shall specify the purpose for which the excavation is to be made, and when the excavation is proposed to begin. In case the excavation is to be made by the city or any of its departments, the application shall be signed by the superintendent of the department under whose direction the work is to be done. All applications shall be numbered and filed with the city clerk.

    (b)

    If an excavation is not to be made by the city or one of its departments, the application shall contain an undertaking on the part of the person proposing to make the excavation with sureties acceptable to the city manager that, in consideration of being permitted to make the excavation, the person will leave the street, sidewalk, alley, or swale ditch in as good condition as it was in when the work was commenced. Applications shall state that at all times the place where the excavation is made will be properly guarded by day and lighted by night so as to warn travelers sufficiently, and will save the city from any damages, costs, and charges that may accrue from the applicant's use of the street, sidewalk, alley, or swale ditch.
